Privacy Policy

Last updated: October 28, 2026

Resistance LLC d/b/a Resistance Lagree (“Resistance,” “we,” “us,” or “our”) operates Pilates and Lagree fitness studios in Illinois. This Privacy Policy explains how we collect, use, disclose, and protect personal information through resistancelagree.com and its subdomains (the “Website”), our mobile application, our studios, classes, communications, and related services (collectively, the “Services”).

The Website is intended for Illinois residents and people visiting Illinois. This Policy does not govern third-party websites, applications, platforms, or services that have their own privacy notices.

Information we collect

Personal information is information that identifies, relates to, describes, or can reasonably be associated with an individual. Depending on how you use the Services, we may collect:

  • Identifiers and contact information, such as your name, email address, phone number, postal address, account or profile name, IP address, and online identifiers.
  • Account and class participation information, such as reservations, attendance, memberships, packages, waitlists, account status, and related studio-participation information.
  • Payment and commercial information, such as classes booked or attended, memberships or packages purchased, transaction records, preferences, and purchase history. Payment-card and billing information are processed by our payment processor; we do not store full payment-card numbers.
  • Internet, device, and approximate location information, such as pages viewed, referring and exit pages, browser and device information, IP-derived approximate location, and interactions with the Website collected through cookies and similar technologies.
  • Communications and information you choose to provide, such as messages, correspondence, photographs, optional gender information, and health or fitness information you voluntarily provide for participation, safety, accommodation, or instructional needs. This may include information about injuries, pregnancy, physical limitations, or accessibility needs.

We may create deidentified or aggregated information that does not reasonably identify you. We use and disclose it only in deidentified or aggregated form and do not attempt to reidentify it except as permitted by law.

How we collect information

  • Directly from you when you create an account, make or redeem a purchase, contact us, complete a form, submit payment, or otherwise interact with the Services.
  • Through studio and booking operations when you create an account, book or attend a class, join a waitlist, purchase a membership or package, sign a waiver, or communicate with studio personnel.
  • Automatically through the Website when technology records device, usage, and log information as described in our Cookie Policy.
  • From service providers that support studio management, scheduling, payments, communications, hosting, security, and website measurement.

How we use information

We use personal information to operate and improve the Services, including to manage accounts, schedules, reservations, attendance, memberships, packages, waitlists, payments, customer service, studio operations, internal business analysis, and offerings. We also use it to communicate with you, protect the Services and our users, prevent fraud and abuse, comply with legal obligations, and resolve disputes. When enabled, our internally developed business-analysis software may use Anthropic’s Claude AI service to help management analyze customer-service requests. That optional capability may process recent SMS message content, client profile notes, and booking or attendance information to assist staff; it does not make booking, payment, or messaging decisions on its own.

Where permitted, we may send communications about classes, memberships, packages, events, and other offerings. You can opt out of promotional email by using the unsubscribe instructions in the message. Promotional text messages require consent where required by law and are not a condition of purchase.

We use necessary website technologies to operate and secure the Website and remember privacy choices. When Analytics is permitted under the choices and regional defaults described in our Cookie Policy, we use Google Analytics 4 to measure Website page views and call-to-action clicks. When the corresponding measurement is enabled, we may also measure studio and product selections, cart activity, and completed purchases. Purchase measurement may include an order identifier and the product, price, quantity, and value associated with the purchase. Our optional advertising and social-media technologies are not currently active. CookieHub manages optional Website technology choices. An Illinois regional default may permit Analytics only; it never permits Marketing. A saved rejection and the browser privacy controls described in the Cookie Policy take priority over a regional default where it applies. These choices apply to our optional Website measurement and do not prevent processing needed to provide a booking, complete a purchase, keep transaction records, or protect the Services.

We may use internally developed or third-party software that links a Website visit from one of our campaigns to your booking account when you sign in or create an account in the booking widget on the Website, and to that account’s purchase history, where permitted by the applicable Website measurement choice, to help us assess campaign performance. For this purpose, that software may receive limited campaign information about the visit and your booking-account identifier. We do not include health information, message contents, or full payment information in this attribution record. Our Website retains approved campaign details in first-party session storage for up to 24 hours and no more than eight recorded campaign touches. We automatically delete the visit and account-link records that software receives from the Website within about 90 days. We keep records of which campaign, if any, was credited with a purchase for up to about 25 months after the purchase date, and then delete them. You may withdraw the applicable Website choice through Cookie Settings; withdrawal stops future optional collection for that purpose but cannot undo a transmission that already occurred. You may also contact us about applicable privacy rights or requests.

We will not use personal information for materially different or incompatible purposes without providing notice and, where required, obtaining consent.

How we disclose information

We do not sell personal information for money. We may disclose personal information to instructors and studio personnel when reasonably necessary to manage classes and participation needs; to service providers that support studio management, scheduling, payment processing, communications, hosting, security, and website measurement; to professional advisers; when required or appropriate for legal and safety reasons; and in connection with a merger, financing, reorganization, or sale of assets.

For example, Mariana Tek/Xplor supports booking, account, and payment flows, and Vercel hosts this Website. Mariana Tek may store client notes created by instructors, including health and fitness information you provide; those notes are accessible to Resistance employees who have access to the Mariana Tek platform. Our internally developed business-analysis software contains a subset of Mariana Tek customer data and is accessible only to the owner, co-owners, and manager. When its optional AI customer-service capability is enabled, Anthropic may process the information described above to provide that assistance. Each provider may process information needed to provide its services under its own applicable terms and privacy notice.

We require service providers that process personal information for us to protect it and use it only to provide their services to us. Depending on the technology and configuration, disclosures to analytics, advertising, or social-media providers may be treated under some laws as sharing or targeted advertising.

SMS / Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

If you opt in to receive text messages from us, we use your mobile number and record of consent to send the messages described in the SMS Program section of our Terms of Service and to honor your opt-out. You may opt out at any time by replying STOP to a message or get help by replying HELP. Message and data rates may apply.

Your choices

You may opt out of promotional emails by following the unsubscribe instructions in the email. You may opt out of promotional or automated text messages by replying STOP, CANCEL, UNSUBSCRIBE, or another recognized opt-out instruction.

You can manage optional Website technology choices through Cookie Settings when the preference center is available. You can make separate category choices there; where required, optional measurement stays off until you explicitly accept it. A rejection or browser privacy control can override an Illinois regional default where it applies. Browser settings may also control some technologies. A choice made through this Website does not automatically control technologies used by a separate booking platform or mobile application; review that provider’s notice and controls when you use those services.

Security and retention

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, and destruction, and limit access to people who need it to provide the Services. No system is completely secure, and we cannot guarantee the security of personal information against every threat.

We retain personal information for as long as reasonably necessary to provide the Services; manage studio operations; maintain account, class, transaction, consent, and waiver records; satisfy legal, tax, accounting, insurance, and safety obligations; resolve disputes; and enforce agreements. If you have a privacy question or request, contact us using the information below.

Children’s privacy

The Services are not directed to individuals under 18. If you believe that a person under 18 has provided personal information to us, please contact us using the information below so that we can review the request.

Linked sites and changes to this Policy

The Website may link to third-party websites or applications. We are not responsible for their content or privacy practices, and this Policy does not apply to them. We encourage you to review their privacy notices.

We may update this Policy from time to time. If our practices change materially, we will post an updated Policy on the Website and provide additional notice where required by law. The date above shows when this Policy was last updated.

Terms of Service

Last updated: October 18, 2026

These Terms of Service (“Terms”) are a binding agreement between you and Resistance LLC d/b/a Resistance Lagree (“Resistance,” “we,” “us,” or “our”). They govern your use of this Website, our mobile application, Illinois studios, classes, memberships, packages, instruction, communications, content, functionality, and related services (collectively, the “Services”).

By using a Service, creating an account, booking or attending a class, purchasing a membership or package, or accepting these Terms where that option is presented, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you satisfy these requirements and are in Illinois or visiting Illinois when receiving in-person Services.

Accounts and security

You may need an account to book classes, join waitlists, purchase memberships or packages, manage reservations, or use app features. You agree to provide accurate, current, and complete information and update it promptly. You are responsible for safeguarding your login credentials and activity under your account. Notify us at info@resistancechicago.com if you suspect unauthorized access. We may suspend or disable an account we reasonably believe has been compromised, used unlawfully, or used in violation of these Terms.

Classes, memberships, packages, and reservations

Resistance offers in-person Pilates and Lagree fitness classes and related instruction at its Illinois studios. Class schedules, instructors, formats, equipment, capacity, and availability may change. Reservations are subject to availability and are not guaranteed until confirmed through the Website, app, or applicable booking platform. Memberships, class packages, introductory offers, promotions, and other purchases may be subject to additional terms shown at purchase; those terms are incorporated into these Terms.

Pricing, payment, and automatic renewal

Prices are displayed when you purchase or book and may change prospectively. You authorize Resistance and its payment processor to charge the payment method you provide for purchases, applicable taxes, and disclosed fees. Payment-card information is processed by a third-party payment processor; Resistance does not store full payment-card numbers.

If a membership or package renews automatically, you authorize recurring charges at the disclosed interval until cancellation takes effect. Before purchase, Resistance will disclose the recurring price, billing frequency, renewal terms, and cancellation method.

Cancellations, no-shows, refunds, and waitlists

Cancel at least four hours before class to avoid losing your credit. ClassPass and other third-party bookings are subject to the policies stated on their platform - we often don't have control over how these are implemented. Unlimited members get one late-cancel / no-show exception per month but may be charged a $19 fee for subsequent absences that were not early canceled.

Class cancellations, waitlists, membership cancellations, package expirations, refunds, and account credits are governed by the terms disclosed at purchase and posted studio policy. Resistance may cancel a class, substitute an instructor, or modify a schedule; if Resistance cancels a class, the affected class credit will be restored or another remedy will be provided as stated in the applicable policy. Except as required by law or expressly stated at purchase, purchases are nonrefundable and nontransferable.

Gift cards and promotions

Gift cards, introductory offers, referral credits, discounts, and promotions may be subject to additional terms disclosed with the offer. If those terms conflict with these Terms, the offer-specific terms control. Promotions may be modified or withdrawn prospectively, subject to applicable law.

Prohibited uses

You may use the Services only lawfully and for their intended purposes. You may not violate law; infringe another’s rights; impersonate another person; submit false, misleading, defamatory, infringing, or harmful material; transmit malware or unsolicited advertising; scrape, harvest, or use automated means to access the Services without permission; interfere with security or operation; gain unauthorized access; misuse another person’s account; record classes or individuals without authorization; resell reservations, memberships, packages, or access; or use the Services for unauthorized commercial activity.

Health, safety, and assumption of risk

Physical exercise, Pilates, Lagree instruction, and use of studio equipment involve inherent risks, including strains, falls, illness, and other injury. You are responsible for determining whether you are physically able to participate. Consult a qualified healthcare professional before beginning or changing an exercise program, particularly if you are pregnant, injured, have a medical condition, or have been advised to restrict activity.

Inform the instructor before class of relevant injuries, limitations, pregnancy, accessibility needs, or other circumstances affecting safe participation; stop immediately if you experience pain, dizziness, shortness of breath, or other concerning symptoms; and follow instructor and equipment-safety directions. The Services do not provide medical advice, diagnosis, or treatment. Participation requires acceptance of the separate informed-consent, release, or waiver agreement presented through Mariana Tek/Xplor.

Studio conduct and personal property

You must follow posted studio rules and reasonable instructions from Resistance personnel, use equipment only as directed, respect other participants and personnel, and refrain from disruptive, threatening, harassing, unsafe, unlawful, or unauthorized commercial conduct. Resistance may refuse entry, remove a participant, or suspend or terminate access for conduct that threatens safety, disrupts operations, or violates these Terms. You are responsible for your belongings. To the fullest extent permitted by law, Resistance is not responsible for lost, stolen, or damaged personal property.

Socks are required for class. Grip socks are encouraged. You must also follow any posted footwear, attire, late-arrival, cellphone, recording, guest, locker, and other studio rules.

Mobile app and app stores

Subject to these Terms, Resistance grants you a limited, personal, revocable, nonexclusive, nontransferable license to download and use the app on a device you own or control solely to access the Services. You may not reverse engineer, decompile, disassemble, copy, modify, distribute, sell, lease, sublicense, or circumvent security features of the app except where applicable law prohibits that restriction. Your use of the app may also be subject to the terms of the applicable app store. The app-store provider is not responsible for the app or the Services and, to the extent required by its terms, is an intended third-party beneficiary of this license.

Intellectual property

The Website, app, and their content, features, functionality, class materials, names, logos, and other intellectual property are owned by Resistance or its licensors and are protected by applicable law. Except for the limited app license, no right or license is granted. You may not copy, record, reproduce, modify, distribute, publicly display, create derivative works from, or commercially exploit any portion of the Services without prior written permission. If you submit feedback, suggestions, or ideas, you grant Resistance a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.

Third-party links and services

The Services may link to or integrate with third-party platforms, including scheduling, payment, maps, social media, communications, analytics, and app-store services. Resistance does not control and is not responsible for third-party content, products, security, availability, or practices. Your use of a third-party service is governed by that provider’s terms and privacy notice. Mariana Tek/Xplor supports booking, account, and payment flows. The app may be made available through the Apple App Store or Google Play, and your use of those stores is also subject to their terms.

Privacy

Our Privacy Policy explains how Resistance collects, uses, discloses, and protects personal information through the Services and is incorporated into these Terms by reference.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RESISTANCE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RESISTANCE DOES NOT WARRANT THAT THE WEBSITE OR APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY CLASS, INSTRUCTOR, SCHEDULE, EQUIPMENT, OR LOCATION WILL REMAIN AVAILABLE; OR THAT PARTICIPATION WILL PRODUCE ANY PARTICULAR FITNESS OR HEALTH RESULT. FITNESS INSTRUCTION IS NOT MEDICAL ADVICE. THESE DISCLAIMERS DO NOT EXCLUDE WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RESISTANCE AND ITS OWNERS, AFFILIATES, INSTRUCTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, RESISTANCE’S TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO RESISTANCE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY TO THE EXTENT CAUSED BY CONDUCT FOR WHICH LIABILITY CANNOT BE WAIVED, OR ANY OTHER LIABILITY THAT APPLICABLE LAW PROHIBITS LIMITING.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Resistance and its owners, affiliates, instructors, employees, contractors, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable attorneys’ fees arising from your unlawful or unauthorized use of the Services, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from Resistance’s own conduct for which indemnification may not lawfully be required.

Term and termination

These Terms remain effective while you use the Services. Resistance may suspend or terminate access for violation of these Terms, unsafe or disruptive conduct, nonpayment, fraud, security concerns, or as otherwise permitted by applicable membership terms and law. Termination does not affect accrued payment obligations. Provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, liability limitations, indemnification, and dispute provisions, will survive.

Governing law and jurisdiction

These Terms and any dispute arising from them or the Services are governed by Illinois law, without regard to conflict-of-laws principles. Unless the parties agree to arbitration in a separate enforceable agreement, any action must be brought exclusively in the state courts located in Cook County, Illinois, or the federal court having jurisdiction over Chicago, Illinois, and each party consents to personal jurisdiction and venue there. Applicable consumer-protection rights that cannot be waived remain unaffected.

Changes to these Terms

We may revise these Terms from time to time. Changes apply prospectively after posting or after any later effective date stated in the notice. For material changes, we will provide reasonable notice and obtain renewed acceptance when required by law. Your continued use of the Services after the effective date of a change constitutes acceptance to the extent permitted by law.

Miscellaneous

These Terms, the Privacy Policy, applicable purchase terms, and any separately signed waiver, release, or membership agreement constitute the entire agreement concerning the Services, except that a separately signed agreement controls to the extent it expressly conflicts with these Terms. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder will continue. Resistance’s failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; Resistance may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. Notices and transactions may occur electronically, and you consent to receive electronic records and communications, subject to your rights under applicable law. Resistance is not liable for delay or failure caused by events beyond its reasonable control.
